MARITAL SETTLEMENT AGREEMENTS

A marital settlement agreement is a contract entered into by a couple intent on divorce.  Such agreement can be designed to completely resolve all of the divorcing couple's issues regarding ending the marriage.  Conversely, a marital settlement agreement can also be designed to settle only portions of a couple's divorce related issue, leaving the remaining issues to be settled later or decided by a judge.

Marital settlement agreements often resolve disputes related to alimony, property division, child custody, parental responsibility, child time-sharing (visitation) and child support.  The parties have flexibiility to resolve their divorce issues in ways a judge, hereing the matter in a contested manner, could not.   

Marital settlement agreements must be entered into by the parties knowing, freely and voluntarily.  To enter into a marital settlement agreement knowingly, each party must fully understand the terms of the agreement and must have an accurate understanding of the other spouse's financial situation.  Further, there can be no coercion in getting a spouse to sign the agreement.
