QUALIFIED DOMESTIC RELATIONS ORDERS - QDRO

Section 61.076, Florida Statutes, provides that "All vested and nonvested benefits, rights, and funds accrued during the marriage in retirement, pension, profit-sharing, annuity, deferred compensation, and insurance plans and programs are marital assets subject to equitable distribution."  Often times, these assets are divided using a court order commonly referred to as a qualified domestic relations order or "QDRO" for short.

These orders can be very complex.  The company that manages the particular retirement asset (commonly referred to as "the Plan Administrator," often has sample QDRO forms available.  Such forms can be difficult to understand, however, and it is best to have an experienced attorney prepare the QDRO.
