QUALIFIED DOMESTIC RELATIONS ORDERS - QDRO
Faulkner Legal Group, P.A., an Orlando divorce law firm, handles a variety of divorce related issues in the Orlando, Central Florida and surrounding areas as well as the State of Florida as a whole. As an Orlando divorce lawyer, attorney David A. Faulkner helps clients going through a divorce divide their retirement property.
Section 61.076, Florida Statutes, provides that "All vested and nonvested benefits, rights, and funds accrued during the marriage in retirement, pension, profit-sharing, annuity, deferred compensation, and insurance plans and programs are marital assets subject to equitable distribution." Often times, these assets are divided using a court order commonly referred to as a qualified domestic relations order or "QDRO" for short.
These orders can be very complex. The company that manages the particular retirement asset (commonly referred to as "the Plan Administrator," often has sample QDRO forms available. Such forms can be difficult to understand, however, and it is best to have an experienced attorney prepare the QDRO.
As an experienced Orlando family law and divorce lawyer, attorney David A. Faulkner represents clients in the preparation and review of QDROs. If you need such a QDRO prepared or reviewed, contact us today.
